General
Customer is referred to in this text as any individual who interacts, request, or receives services and products from DSM Overhauls. DSM Overhauls is A DBA of Winterset Aviation Services Inc. DSM Overhaul services and products are offered to you conditioned on your acceptance without modification of these terms, conditions, and notices contained herein (the “Terms”).  Your agreement to obtain products and/or services from DSM Overhauls constitutes your agreement to all these Terms. Please read these terms carefully, and save the link to these terms and conditions. Saving the link ensures that customers have the most up to date version of these terms.

Electronic Communications
Visiting dsmoverhauls.com or sending emails to DSM Overhauls constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on this website, satisfy any legal requirement that such communications be in writing.

Indemnification
The Customer agrees to indemnify and hold harmless and defend DSM Overhauls member(s), officers, employees, and contractors from and against all claims and suits for damages, injuries to persons (including death), property damages, losses, and expenses including court costs and reasonable attorney’s fees, arising out of, or resulting from, DSM Overhauls performance of engine overhaul services provided to the customer, including all such causes of action based upon common, constitutional, or statutory law, or based in whole or in part, upon allegations of negligent or intentional acts on the part of DSM Overhauls, its officers, employees, agents, contractors, licensees, or invitees.

Arbitration
All claims and disputes arising under or relating to this Agreement are to be settled by binding arbitration in the state of Iowa. An award of arbitration may be confirmed in a court of competent jurisdiction.

Changes to Terms
DSM Overhauls reserves the right, in its sole discretion, to change these terms. The most current version of the Terms will supersede all previous versions. DSM Overhauls encourages you to periodically review the Terms to stay informed of our updates.
